One of the hardest things to do in an organization is to decide how to meet a pressing need. The pressing need might be for new equipment or additional space. It could be the development of a new product or service. Or perhaps it is reducing legal risk, strengthening governance and getting better value from your legal spend. It is often assumed that once activity levels and legal cost reach a certain level this need can only be met through the hiring of an “in-house counsel.” The reality of what options are available is far more complicated.
Having been leaders responsible for legal, risk, business divisions and cross platform teams we know that there are many options to meet this need. Like what? Well before you get there it starts with what you do, where you do it, who does it, how you do it and who you do it for. It requires a consideration of risk management tools, like insurance and governance. It necessitates a view as to where you are going and how fast. Invariably, the last thing you should probably do is hire a lawyer as an employee given the multitude of progressive options that can be tailored to meet your in-house counsel needs.
